You are solely responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
4. Booking and Reservations
4.1 Booking Process
When making a booking through our website, you agree to provide accurate, complete, and current information. A booking is not confirmed until you receive a booking confirmation from us via email. All bookings are subject to availability and our acceptance.
4.2 Payment Terms
We accept payments via bank transfer, credit/debit cards, and cash payment at the property. For cash payments, a 24-hour hold period applies, after which the booking will be automatically cancelled if payment is not received. All prices are quoted in Thai Baht (THB) and include applicable taxes unless otherwise stated.
4.2.1 Credit Card Processing
Credit card payments are processed securely through certified third-party payment processors in compliance with international security standards. We do not store your credit card information on our servers. Payment data is encrypted and processed in accordance with PCI DSS compliance standards.
4.2.2 Data Protection for Payments
We comply with Thailand's Personal Data Protection Act (PDPA) B.E. 2562 (2019) in handling all payment and personal data. Payment information is shared only with authorized payment processors for transaction completion. We retain transaction records as required by Thai law for accounting and dispute resolution purposes.
4.2.3 Refund Policy
Refunds, if applicable according to the cancellation policy, will be processed to the original payment method. Refund processing times vary by payment method: credit cards (5-10 business days), bank transfers (3-5 business days). Refund amounts may be subject to processing fees as determined by the payment processor or banking institution.
4.3 Cancellation Policies

4.4 Check-in and Check-out
Standard check-in time is 2:00 PM and check-out time is 12:00 PM, unless otherwise specified. Early check-in or late check-out may be available upon request and may incur additional charges. Valid government-issued photo identification is required upon check-in.
4.5 Age Requirements
Guests must be at least 18 years old to make a booking. Minors must be accompanied by an adult. Some properties may have additional age restrictions which will be specified in the property description.
We reserve the right to cancel or refuse any booking at our discretion, particularly in cases of suspected fraud, unavailability of the property, technical errors, or non-compliance with property rules or Thai law.
4.6 Thai Licensing Requirements and Restrictions
Important Notice: In accordance with Thai law, accommodation properties must obtain proper licensing from the Tourism Authority of Thailand and local authorities to operate legally as tourist accommodation.
30-Day Restriction for Unlicensed Properties: Properties that do not possess valid tourism business licenses or accommodation licenses may only accept bookings for periods of 30 days or longer, as they may only operate as long-term residential accommodation rather than short-term tourist lodging.
Properties with proper licensing can accept bookings of any duration. The licensing status of each property is verified by our team, and booking restrictions are automatically applied where necessary to ensure legal compliance.
By proceeding with a booking, you acknowledge that you understand these legal requirements and agree that any booking modifications required for legal compliance will be accommodated without penalty to you.
5. Data Protection and Privacy
We are committed to protecting your personal data in accordance with the Personal Data Protection Act B.E. 2562 (2019) of Thailand. By using our services, you consent to the collection, use, and processing of your personal data as described in our Privacy Policy.
5.1 Google Services Integration

- Comply with all applicable laws, including disclosure requirements

- Not create artificial or fraudulent bookings

Commission rates, payment terms, and tracking methods are specified in the Affiliate Agreement provided upon approval to the program. We reserve the right to change these terms with reasonable notice.
8. Intellectual Property
All content on our website, including text, graphics, logos, images, audio, video, and software, is the property of Stay in Pattaya or our content suppliers and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our website without our explicit written permission.
Affiliates are granted a limited, revocable license to use our approved marketing materials solely for the purpose of promoting our services within the terms of the Affiliate Agreement.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our website or services.
We do not guarantee the accuracy, completeness, or reliability of any content on our website. Property descriptions, amenities, and images are provided by property owners and are their responsibility.
Platform Role Clarification: Stay in Pattaya operates as both a direct accommodation operator for properties we own or manage, and as a booking marketplace for third-party property owners. Our role varies by property:
- Direct Operations: For properties we operate directly, we are responsible for service delivery, accommodation standards, and guest experience.
- Marketplace Services: For third-party properties, we act as an intermediary facilitating bookings between you and property owners. Property standards, service quality, and guest experience are the responsibility of the individual property owners.
The property listing will indicate whether we operate the property directly or if it is managed by a third party. Any issues arising from your stay should be addressed according to the property's management structure, though we will make reasonable efforts to assist in resolving disputes regardless of our operational role.
10. Indemnification
You agree to indemnify, defend, and hold harmless Stay in Pattaya, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of our website, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.
11. Third-Party Links and Services
Our website may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
12. Force Majeure
We shall not be liable for any failure to perform our obligations where such failure is a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, civil unrest, government order, national or regional emergency, strikes, labor disputes, or other force majeure events beyond our reasonable control.

16. Dispute Resolution
Any disputes arising from or relating to these Terms or our services shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation in accordance with the laws of Thailand.
If mediation is unsuccessful, the parties agree to submit to the exclusive jurisdiction of the courts of Thailand for the resolution of any disputes.
